On 16 Nov 2020, Thailand Transfer Pricing Ministerial Regulation No. 370 was gazetted stipulating the amount for related companies being exempt from the Transfer Pricing reporting, documentation and evidence compliance laws.
As enacted into the TP laws on 21 Nov 2018, and applying from 01 Jan 2019:
The provisions in Section 71 ter do not apply for a related company with gross business income up to an amount that's stipulated in a Ministerial Regulation, which amount shall not be less than 200 million baht.
Ministerial Regulation No. 370
The Ministerial Regulation No. 370 prescribes:
The stipulated amount of gross business income for a related company in Section 71 ter paragraph three is not exceeding 200 million baht.
That is, a related company with gross business income not exceeding 200 million baht is exempt from the reporting, documentation and evidence requirements of the Transfer Pricing laws.
